Terms of Service

These terms govern your use of MediClear, whether you're a member of a veterinary hospital's staff or a pet parent using the pet parent portal. By creating an account, you agree to them.

Before this goes live: this is a thorough draft covering the obligations typically required across the US, UK, India, and EU, written against what MediClear actually does today. It should be reviewed by a qualified lawyer, and the governing-law and dispute-resolution sections in particular should be confirmed against where the operating company is actually incorporated.

1. Acceptance of these terms

By creating a MediClear account — as clinic staff or as a pet parent — you agree to these Terms of Service and to the Privacy Policy, which is incorporated into these terms by reference. If you are creating a staff account on behalf of your hospital, you confirm you have the authority to bind that hospital to these terms.

2. Who can use MediClear

You must be at least 18 years old, or the age of majority in your jurisdiction, and able to enter a binding contract, to create an account. Staff accounts are provisioned by a hospital administrator on a colleague's behalf; the administrator is responsible for confirming that colleague has been made aware of, and agrees to, these terms before the account is used. Pet-parent accounts are self-registered using a mobile number.

3. What MediClear is — and isn't

MediClear is practice-management software: appointments, billing, records, and AI-assisted discharge summaries for veterinary hospitals. MediClear is not a veterinary practice, does not employ veterinarians, and does not itself provide veterinary advice or care. All clinical judgment, diagnosis, and treatment decisions remain the responsibility of the licensed veterinary professionals using the software. MediClear is also not a certified medical device, and its AI features are a communication aid, not a diagnostic tool.

4. AI-generated content

Discharge summaries, translations, and any content read from a photo (a prescription or a paper history document) are generated or assisted by an AI model. We instruct the model not to invent medications, dosages, or dates — but AI can still make mistakes, a summary can miss nuance, and an image can be misread. Discharge summaries carry a visible notice to that effect for exactly this reason. Neither clinic staff nor pet parents should treat AI-generated content as a substitute for a licensed veterinarian's direct advice, and staff are expected to review AI output before sharing it with a pet parent.

5. Your account

You are responsible for keeping your password confidential and for all activity under your account. Tell us immediately if you suspect unauthorized access. Practice administrators are responsible for the staff accounts they create and for removing access promptly when someone leaves the practice — MediClear currently deactivates staff access by role change rather than a separate offboarding flow, so an administrator should update or reassign a departed colleague's role.

6. Billing, payments, and insurance

MediClear lets a hospital record invoices and payments it has received through its own means (cash, UPI, card, cheque, or bank transfer). MediClear does not process, hold, or transmit payments itself — it is a record-keeping tool, not a payment processor, and we make no representation about the accuracy of amounts a hospital enters. Similarly, MediClear lets a hospital track an insurance claim's status, but MediClear is not an insurer, broker, or claims administrator, has no live connection to any insurer's systems, and does not guarantee any claim outcome.

7. Acceptable use

You agree not to:

  • Use MediClear for any hospital, client, or patient record you are not authorized to create or view.
  • Attempt to access another hospital's data, or circumvent the access controls that keep hospitals' data separate.
  • Upload content that is unlawful, infringes someone else's rights, or is not genuinely related to the veterinary record it's attached to.
  • Interfere with, overload, or attempt to reverse-engineer the service.
  • Use any automated system to scrape or extract data from MediClear beyond normal use of the app.

8. Content ownership and license

Your hospital owns the client and patient records it creates in MediClear; a pet parent owns the information they submit about themselves and their pet. By using the service, you grant MediClear a limited license to host, process, and display that content solely to provide the service to you — including sending the specific inputs described in the Privacy Policy's AI section to our AI provider. We claim no ownership over your clinical or business data. MediClear's own software, design, and branding remain our property and may not be copied or reused without permission.

9. Third-party services

MediClear relies on infrastructure and AI providers to operate, as described in the Privacy Policy. Your use of MediClear is also subject to those providers continuing to operate; we are not liable for an outage or limitation originating from a third-party provider outside our control. If you are a hospital, MediClear's processing of your client and patient data — including these sub-processors — is additionally governed by the Data Processing Agreement, incorporated into these terms by reference.

MediClear does not currently send SMS or WhatsApp messages on a hospital's or a pet parent's behalf. If that changes, use of any such feature will be subject to the consent terms described in the Privacy Policy's “Looking ahead — direct messaging” note, which these Terms incorporate by reference in advance of that feature shipping.

10. Disclaimers

MediClear is provided “as is” and “as available.” To the fullest extent the law allows, we disclaim all warranties, express or implied, including fitness for a particular purpose and non-infringement. We do not warrant that the service will be uninterrupted, error-free, or that AI-generated content will always be accurate. Nothing in this section limits any consumer protection that cannot lawfully be waived in your jurisdiction (for example, statutory rights under UK or EU consumer law).

11. Limitation of liability

To the fullest extent the law allows, MediClear and its operator are not liable for indirect, incidental, or consequential damages arising from your use of the service, including reliance on AI-generated content that a qualified veterinarian did not independently verify. This limitation does not apply to liability that cannot be excluded by law, including liability for death or personal injury caused by negligence where such an exclusion is unlawful.

12. Indemnification

You agree to indemnify MediClear against claims arising from your breach of these terms, your misuse of the service, or content you submit that infringes someone else's rights or violates applicable law.

13. Termination

You may stop using MediClear at any time. A hospital administrator can remove a staff member's access at any time. We may suspend or terminate an account that violates these terms, poses a security risk, or where required by law. On termination, records are handled as described in the Privacy Policy's retention section.

14. Governing law and disputes

These terms are governed by the laws of India, and any dispute not otherwise resolved will be subject to the exclusive jurisdiction of the courts located where MediClear's operating entity is registered, without prejudice to any mandatory local consumer-protection or data-protection rights you have as a resident of the UK, the EU, or a US state, which this clause does not override.

15. Changes to these terms

We may update these terms as the service changes. If a change is material, we will update the date at the top of this page and make a reasonable effort to notify active users before it takes effect. Continued use after a change takes effect means you accept the updated terms.
